Sponsors and co-sponsors can use assets if income too low

I have a case where the U.S. citizen sponsor for her husband to get a green card is a part-time teacher and does not earn the $18,212/yr. required for her to sponsor her husband for a green card. Yet the couple has equity in their home. Her income of $11,000 is $8,212 short of the requirement. Under immigration regs, she can still meet the requirement if she can show assets equal to five times the amount of the shortfall. That means we multiply $8,212 by 5, which gives us $41,060. The equity in their home is more than that, so we just need to include these numbers in the I-864 Affidavit of Support and provide documentation showing the amount of equity in the home. Even if she did not meet the requirement, we could use a co-sponsor. www.asburylaw.net….
